1Who operates this website
The MRTY website at mrty.ai is operated by ALWAYS ON LIMITED, trading as MRTY, NZBN 9429049927702, of Flat 12, 49 Sainsbury Road, Mount Albert, Auckland 1025, New Zealand. “We”, “us” and “our” refer to that company. Contact hello@mrty.ai.
These terms govern website access, website content, signup, enquiries, the website assistant and demo bookings. They do not govern the purchase or use of MRTY products, hardware, software licences or customer services. Those are subject to separate agreements provided at the appropriate stage.
We make these terms available before relevant website interactions. Where agreement is required for a website feature, you must accept them to use it. These terms apply only to the extent validly incorporated under applicable law. Visiting the website does not itself create a paid customer agreement.
2Enquiries, signups and authority
Provide accurate details and use contact information you are authorised to provide. If you enquire for an organisation, you must be authorised to do so. Authority to request information does not by itself authorise you to purchase products for that organisation.
Do not submit passwords, payment-card details, identity documents or unnecessary sensitive or confidential information through the website assistant or enquiry forms. Please correct inaccurate booking details promptly.
Signing up, requesting website access or booking a demo does not create a purchase, subscription, payment authorisation or commitment to a paid fit-gap assessment. Any paid engagement requires a separate agreed scope and commercial agreement.
3Demo requests and booking decisions
Demo availability is shown during booking and remains subject to confirmation. We may use information such as your organisation's industry, team size, location and requirements to assess suitability and route or decline a request. You can ask for human review by emailing hello@mrty.ai.
Please check the date, time and displayed time zone before confirming. To cancel or reschedule, follow the booking instructions or contact hello@mrty.ai. If we need to change or cancel a booking, we will notify you using the contact details provided and, where practicable, offer an alternative.
A demo request or confirmation does not guarantee that a product or service is suitable for you or available in every country. Website access and international enquiries are separate from any later decision to supply.
4Website assistant and voice features
The website assistant is an AI system, not a person. It supports enquiries and bookings, and its spoken replies use a synthetic voice. Voice use is optional, and a text or form alternative is available. Website voice processing, including Fish Audio's role, is described in our Website Privacy Policy and the notice shown before microphone use.
Automated replies and speech transcription may contain errors or misunderstand your request. Check names, contact details, dates, prices and other material information. Contact us for clarification where an answer is unclear or important to a decision.
The assistant cannot enter into a paid agreement for MRTY or approve a purchase on your behalf. Its replies are general information, not legal, financial or other professional advice. This does not remove any obligation we have under law concerning information or representations made through our website.
5Website access and security
Where website access is restricted, use only access provided to you or which you are otherwise authorised to use. Keep personal access links and sign-in details secure, and do not share them with unauthorised people. Tell us promptly if you suspect misuse.
We may restrict access when reasonably necessary to protect the website, investigate misuse or comply with law. Where reasonably practicable and lawful, we will explain the restriction and provide a contact route to resolve it. This is a website-access provision, not a product suspension or software licensing term.
6Acceptable use
You must not:
- Use the website unlawfully or to infringe another person's rights.
- Impersonate someone, submit fraudulent requests or provide misleading booking information.
- Attempt unauthorised access, bypass security or access non-public information without permission.
- Introduce malware, interfere with the website or place unreasonable load on it.
- Use website forms to send spam, harass others or submit unlawful material.
- Extract or reuse personal information from the website without an appropriate lawful basis.
These restrictions do not limit rights that applicable law does not allow us to restrict.
7Website content and intellectual property
MRTY or its licensors own the website's text, graphics, design, branding and other protected content, except where stated otherwise. You may view it and retain reasonable copies for evaluating MRTY or maintaining a record of your enquiry. Further commercial reuse requires permission unless permitted by law or an applicable licence.
You retain your rights in information you submit. You permit us to process that information as reasonably needed to operate the enquiry and booking features and respond to you, in accordance with the Website Privacy Policy. This is not a transfer of ownership or permission to train AI models on your enquiry content.
Third-party names and marks belong to their owners. Their appearance does not by itself establish endorsement, partnership or certification.
8Information, links and availability
We take reasonable care with website information, but content can become outdated and features may change. Product descriptions, previews and indicative information are not binding purchase commitments unless included in a separate accepted agreement. Nothing in this clause permits misleading statements or removes rights arising from them.
The website may link to third-party sites or use third-party functionality. Those providers may have their own terms and privacy information. We remain responsible for obligations that applicable law places on us, including our own handling of personal information.
We may maintain, update or temporarily interrupt the website. We do not promise uninterrupted or error-free access. Where practicable, we aim to minimise disruption. An enquiry that has not reached a confirmation screen or received confirmation should not be assumed to have been booked; contact us if unsure.
9Privacy and communications
Our Website Privacy Policy explains what we collect through the website, why, who receives it, retention, international handling and your rights. It is available at mrty.ai/privacy.
We may contact you to respond to your enquiry and administer your requested booking or website access. Optional promotional communications are handled separately with the permissions and unsubscribe options required by law. Accepting these terms is not blanket consent to marketing or every use of personal information.
10Responsibility and legal rights
Nothing in these terms excludes or limits rights, duties, guarantees or liability that cannot lawfully be excluded or limited. This includes protections against misleading conduct and any applicable consumer protections.
Each party remains responsible to the extent required by applicable law for loss caused by its acts or omissions. Reasonable steps should be taken to avoid or reduce loss. We do not impose an arbitrary fixed liability cap, a blanket exclusion of liability for our own conduct or an unlimited indemnity on website visitors.
These terms do not determine liability or remedies for any later product or service purchase; the applicable agreement and mandatory law govern that relationship.
11Changes to these terms
We may update these website terms prospectively. We post the revised version with its effective date and provide appropriate notice of material changes affecting existing website access. Where renewed acceptance is legally required, we obtain it.
Changes do not retrospectively alter an existing purchase agreement or remove rights already accrued. Any separate customer agreement has its own change provisions.
12Questions, disputes and governing law
Contact hello@mrty.ai with questions, booking issues or complaints. We will try to resolve concerns fairly and in good faith. You may still contact an appropriate regulator or bring proceedings in a court or tribunal entitled to hear them.
New Zealand law governs these website terms, subject to mandatory protections under other applicable laws. New Zealand courts have non-exclusive jurisdiction, preserving any mandatory right to bring proceedings elsewhere.
If a provision is unenforceable, the remaining provisions continue to the extent legally possible. A delay in enforcing a provision is not a waiver of the right to enforce it.
